Transport, handling and warehousing Conditions

For carriages, handling and lifting operations in Switzerland, we work according to articles 440ff of the swiss « Code des Obligations » (CO), amended by the ASTAG Conditions, latest valid edition.

• Carriages as per ASTAG/CO within Switzerland: CHF 15.- per kilo gross weight of the affected part of the shipment
• Maximum amount per carriage, handling or lifting operation: CHF 40’000.00

For international carriages within Europe – with loading and delivery of the carried goods in two different countries – the CMR (Convention relative au Contrat de transport international de Marchandises par Route) applies.

• CMR Carriages (SDR = special drawing rights): SDR 8.33 per kilo gross weight of the affected part of the shipment (SDR 8.33 = about CHF 11.-, according to exchange rate)

For all our operations as freight forwarders, we work according to articles 439ff of the swiss « Code des Obligations » (CO), amended by the « General Conditions of Spedlogswiss – Swiss Freight Forwarding and Logistics Association », latest valid edition.

In case of damage – and only if we are responsible according to the above mentioned dispositions – our liability is limited as follows:

• according to the SPEDLOGSWISS limits: SDR 8.33 per kilo gross weight of the affected part of the shipment (SDR 8.33 = about CHF 11.-, according to exchange rate)
• total liability per claim not exceeding: SDR 20’000 (= about CHF 26’000.-)

For all our operations as warehouse keeper, we work according to articles 472ff of the swiss « Code des Obligations » (CO), amended by the « General Conditions of Spedlogswiss – Swiss Freight Forwarding and Logistics Association – for Warehousing », latest valid edition.

In case of damage – and only if we are responsible according to the above mentioned dispositions – our liability is limited as follows:

• according to the SPEDLOGSWISS limits: SDR 8.33 per kilo gross weight of the affected part of the shipment (SDR 8.33 = about CHF 11.-, according to exchange rate)
• total liability per claim not exceeding: SDR 20’000 (= about CHF 26’000.-)

Notes regarding Warehousing

As warehouse keepers, we only have to insure the stored goods against the risks of fire, water, theft or damage due to another occurrence if there is an express written order of the person storing the goods with information as to the insured value and risks to be covered. Conditions and premium rates are available on request.

In cantons in which the risks of fire and natural events must necessarily be insured by the cantonal fire establishment, our clients are requested to take the necessary steps in order to insure these risks directly with these establishments according to the law.

We are insured for all legal and contractual liabilities according to positions 1 to 3.
